Indemnity and Limitation of Liability

1. Voluntary Participation and Assumption of Risk

By booking and participating in any tour, transfer, or experience organized by Come C Cape Town, the client acknowledges that certain activities involve inherent risks. These risks include, but are not limited to: transport on public roads, water-based activities, exposure to natural elements, crowded venues, and nightlife environments. The client voluntarily assumes all risks associated with their participation.


2. Indemnity and Release

To the maximum extent permitted by law, the client hereby releases, waives, and holds harmless Come C Cape Town, its directors, employees, sub-contractors, and designated safety drivers from any and all liability, claims, demands, or causes of action arising out of:


Any personal injury, illness, or death sustained during the tour.

Any loss, theft, or damage to personal property, luggage, or valuables, regardless of how it occurs.

Any actions, negligence, or omissions of third-party service providers (including hotels, venues, clubs, boat operators, and restaurants).

3. Force Majeure (Acts of God)

Come C Cape Town shall not be held liable or responsible for any loss, damage, delay, cancellation, or inconvenience caused by circumstances beyond its reasonable control. These include, but are not limited to:

  • Acts of God (extreme weather, storms, floods, or natural disasters).
  • Civil unrest, strikes, riots, or acts of terrorism.
  • Governmental restrictions, road closures, or sudden venue cancellations. In the event of a Force Majeure occurrence, Come C Cape Town will make reasonable efforts to offer an alternative itinerary or reschedule the experience, but cannot guarantee full refunds for expenses already committed to third parties.
4. Client Responsibilities and Safety Conduct

The client agrees to strictly adhere to all safety briefings, laws, and instructions provided by the tour guide or safety driver. Come C Cape Town reserves the right to terminate a client's participation immediately, without refund, if their behavior is deemed unlawful, disruptive, or a danger to themselves or others.
